In Colorado, the so-called ‘make my day’ law permits any degree of physical force, including deadly physical force, against an intruder who:
1. makes a knowing, unlawful entry into your home and
2. if the occupant reasonably believes the intruder was committing or intended to commit an additional crime against a person or property in the dwelling, other than the illegal entry, and
3. the occupant reasonably believes the intruder might use physical force against any occupant.
Just the ticket to get a murder charge dismissed, as Patrick Rau, 29, discovered. He shot and killed Donald Russell, 37, a homeless man, in his house on 19 January 2017. Apparently he found Russell in his house and gave him five seconds to leave, then blasted him.
